Tackleandmore – General terms & conditions

1. General terms & conditions

1.1. The tackleandmore webshop has its registered office at 1910 Nederokkerzeel (Belgium), Mussenhoek 3, KBO 084.687.9581, VAT BE 084.687.9581 (hereinafter: "Tackleandmore", "we/us"). These general terms and conditions establish the rights and obligations of Tackleandmore and of the users of the Tackleandmore Webshop (hereinafter: "the customer", "you/your") with regards to the products and services we offer through this webshop or any other website. Before you click on the "Order and pay safely" button, please read these General Terms and Conditions and our Privacy Policy carefully. When you use the Tackleandmore Webshop you confirm that you accept the General Terms and Conditions and the Privacy Policy. If you do not accept these terms and conditions, do not place an order. Only the terms and conditions below apply to the activities between you and . Other terms and conditions will only apply if they have been accepted by us in writing.

TACKLEANDMORE may amend the Terms and Conditions at any time. Any order placed after the adjustment assumes that you have accepted it. The General Terms and Conditions can be supplemented by other conditions if explicitly referred to. In case of contradiction, the current General Terms and Conditions prevail.
 

1.2. We sell our products only to consumers aged 18 and over and only in quantities customary for consumers.
 

2. Concluding an agreement:

2.1. The presentation of our products in the TACKLEANDMORE Webshop is only an invitation to order products from us without obligation. By submitting your order, you are making a binding offer to conclude a sales contract. This offer is accepted by us as we deliver the products. We are free to decide whether or not to accept an order. If we do not fulfill an order, we will inform you of this without delay (see point 3).
 

2.2. The ordering process in the TACKLEANDMORE Webshop consists of the following steps:

  • You can select individual products and collect them in an electronic shopping cart by clicking on the "Shopping Cart" button. From the shopping basket you proceed to checkout by clicking on the "Checkout" button.

  • Then you need to register. If you are not yet a user of the TACKLEANDMORE Webshop, you will be asked to create a new account by entering your contact details. If you are already a user, you will be asked to log in to your account. We require a minimum of personal information to process your order.

  • Then you choose the delivery method you prefer. You can pick up your order free of charge atTACKLEANDMORE. You can also opt for home delivery. For an order under €50, you will pay shipping costs. For an order over €50, your shipping is free.

  • Finally, you choose the desired payment method, enter the payment information and you will be asked to accept the Terms and Conditions. By clicking on the button "Order and pay safely" you will then be redirected to the module of our payment provider (see point 5). Until you have clicked this button, you can change the order and the data accompanying your order at any time.
     

A binding offer only comes into effect when you have entered all the data required for the conclusion of the contract, when you have confirmed that you are familiar with and accept these general terms and conditions, when you have clicked on the "Order and pay safely" button and when the payment via our payment provider's module has been completed successfully. The latter will be the case when you are returned to our website by the payment provider.

At the end of this procedure, you can print and/or save your order; an overview of your order can always be found under your personal account in "My TACKLEANDMORE".

After you place your order, you will receive an automatically created receipt of your order by email. This receipt merely documents that your order has arrived with us; it is not an acceptance of the order and does not create a sales contract. The order is accepted by us by delivering the products. The order will be delivered upon receipt of your payment.

2.3. TACKLEANDMORE has the right to refuse orders among others:

  • in the event of stock exhaustion or the unavailability of a product (see point 3);

  • in the event of an invalid presentation of products in the TACKLEANDMORE Webshop;

  • in case of serious suspicion of abuse of rights or bad faith on the part of the Customer

  • in case of force majeure;

  • when it can be assumed that the customer intends to resell the items himself.

3. Product availability:

If, during the processing of your order, we determine that one or more of the products you ordered are not available, we will unfortunately be unable to fulfill your order in full. We reserve the right, in such a case, to choose to partially fulfill the order or to refuse it altogether. You will be promptly notified in this regard by email. An agreement on the unavailable products will not be established, refunds are guaranteed (see point 6).

4. Delivery

4.1. Products will only be delivered in the countries for which the TACKLEANDMORE Webshop allows delivery at this moment, i.e. Belgium, Germany, the Netherlands and France.
 

4.2. You can choose the delivery method you prefer: collection from TACKLEANDMORE or home delivery.
 

Collection from TACKLEANDMORE:

You can pick up your order at TACKLEANDMORE within ten days of being notified by us by email that your order has been packed. If the order is not collected within this period, we will refund you the price of the products ordered within 14 days.

Delivery to an address:

For customers in Belgium, Germany, the Netherlands or France:

For orders under €50, you will pay shipping costs for a home delivery.

In the course of the ordering process, you will receive an indication of the shipping costs. The shipping costs will be definitively calculated at the end of the ordering procedure, before you finalize it by clicking the button "Order and pay safely" and your payment will be handled by our payment provider.

For customers in other countries:

4.3. Incorrectly submitted addresses are the responsibility of the Customer and may result in additional charges. PO Box addresses and military APO addresses are not accepted.
 

4.4. Depending on the delivery method you have chosen, the order will be dispatched, to the extent possible and in the normal course of business, within approximately three to five working days from the order date provided that your details are correct (for customers in countries other than Belgium and the Grand Duchy of Luxembourg, the delivery time may vary). You can follow the status of your order through your account in "My TACKLEANDMORE". Any delay will in no case give rise to compensation.
 

4.5. Until we have begun processing your order, you may revoke your order without charge by contacting us at info@tackleandmore.be

We will refund you the price of the ordered products within 14 days. If your order has already been delivered, you can return it (see point 6 about return policy).
 

4.6. If, due to exceptional circumstances, we are unable to deliver your order within 30 days of the automatically generated confirmation e-mail, you may cancel this order free of charge by contacting us at info@tackleandmore.be. We will refund you the full price of the products ordered (including the shipping costs paid by you) within 14 days.
 

5. Price and payment:

5.1. The prices indicated at the time of the order apply. TACKLEANDMORE reserves the right to correct any errors (e.g. due to technical defects). The prices of the TACKLEANDMORE Webshop are valid while they are online and while stocks last. All prices include VAT.
 

5.2. We charge shipping costs for the delivery of an order under €50. Delivery of an order over €50 and pick up at TACKLEANDMORE is free of charge (see point 4).
 

5.3. Payment of your order will be made according to the payment methods offered in the TACKLEANDMORE Webshop and the terms and conditions mentioned there. Depending on the result of the verification of your data, we reserve the right to exclude certain methods of payment. Please note that due to your agreements with banks and other credit institutions, additional costs may be incurred. ontstaan.

We opt for a secure payment formula. To enter your card details you will therefore be redirected to the module of our payment provider. The exchange of your data with our systems is secured via an SSL (Secure Socket Layer) certificate (see FAQ for more explanation). We also refer to our Privacy Policy.
 

6. Return policy:

6.1. You have the right to withdraw from the contract within a period of 14 days without giving reasons. To exercise this right, you must inform us of your decision to withdraw from the contract by an unequivocal statement (e.g. by post, fax or e-mail). You may use the model withdrawal form for this purpose, but you are not obliged to do so. We will send you an acknowledgement of receipt of your revocation by email.
 

The right of withdrawal does not apply to products that have been produced individually or according to your customer specifications.
 

MODELREVOCATION FORM

Please complete and return this form only if you wish to withdraw from the contract to TACKLEANDMORE, Mussenhoek 3, 1910 Nederokkerzeel, Belgium (E-mail: info@Tackleandmore.be):

Without delay and at the latest within 14 days after we have been informed of your decision, we will refund the price paid including delivery costs (with the exception of any additional costs resulting from your choice of a mode of delivery other than the cheapest standard delivery offered by us) using the same means of payment with which you paid. We may wait with the refund until we have received the products back or you have demonstrated that you have returned the products, whichever comes first.
 

You shall return the product to TACKLEANDMORE, Mussenhoek 3, 1910 Nederokkerzeel, Belgium, without undue delay and in any event not later than 14 days from the day on which you communicate your decision to revoke the agreement to us.

TACKLEANDMORE will bear the costs of the return shipment.


The withdrawal period expires 14 days after the day on which you took physical possession of the product. 
 

You may only unpack or use the products during the withdrawal period to the extent necessary to judge whether you wish to retain the product. Returned goods must be in the original, unopened packaging. You are liable for the reduction in value of the products resulting from handling of the goods beyond what was necessary to establish the nature, characteristics and functioning of the goods. We therefore recommend that, you do not remove the original price tags, do not open the packaging and do not use or damage the products.

If the quality of the products is impaired due to their use in a more comprehensive manner than described above, TACKLEANDMORE reserves the right to claim compensation from you for any loss of value.
 

6.2. For customers in Belgium, Germany, the Netherlands and France:

You can return the products TACKLEANDMORE free of charge using the enclosed return document. 

When returning to TACKLEANDMORE, you must present the products together with a printout of your order. You may exchange the products, obtain a credit for their value, or have the price of the returned products refunded by return debit card. The shipping costs you paid to receive the products will only be refunded if all the products ordered are returned in full. 

Please note that cash will not be refunded under any circumstances! 

You can also make a return via Bpost (for customers in Belgium), PostNL (for customers in the Netherlands) or DPD (for customers in Germany). Please contact us at info@tackleandmore.be to have this arranged. 

Pack the items in a sealed container, affix the return label and bring your return to a Bpost parcelshop (for customers in Belgium), PostNL (for customers in the Netherlands) or DPD (for customers in Germany) free of charge if you use the return sticker. If you do not use this return sticker, you will have to bear the shipping costs. We will refund you the price of the returned products within 14 days of receipt of the return. The shipping costs you paid to receive the products will only be refunded in the event of a complete return of all the products ordered. 

If you have purchased a joint offer of products at a reduced price and wish to return part of this order, we will pay to you the difference between the amount paid by you for the entire joint offer and the sum of the unreduced price of the products that are part of the joint offer that you do not return.

7. Warranty:

7.1. If the delivered goods do not comply with the placed order, the legal warranty period of two years applies (art. 1649bis et seq. of the Civil Code).
 

If you wish to invoke the statutory warranty, you must prove that you purchased the delivered good from TACKLEANDMORE. You may provide proof of your purchase by any means of common law.

Any defect in the product must be reported within two (2) months of its discovery. Thereafter, any right to repair or replacement shall cease to exist.
 

7.2. In any case, you will not be able to claim any warranty:

  •  for normal wear and tear of the product

  • for injudicious or abnormal use of the product or use of the product contrary to the purpose for which it was designed

  • Failure to follow the operating and/or maintenance instructions

  • If the product is damaged due to intent or negligence.

  • In the event the product has been modified by you or by a third party not designated by TACKLEANDMORE.

  •  in the event of commercial use.
     

8. Liability:

8.1. Use of the TACKLEANDMORE webshop:

The information on the website is of a general nature. The information is not adapted to personal or specific circumstances and can therefore not be regarded as personal, professional advice to the user.

TACKLEANDMORE makes great efforts to ensure that the information provided is complete, correct, accurate and up-to-date. Despite these efforts, inaccuracies may occur in the information made available. If the information provided contains errors or if certain information on or via the site is unavailable, TACKLEANDMORE will make every effort to rectify the situation as soon as possible. TACKLEANDMORE cannot however be held liable for direct or indirect damage resulting from the use of the information on this site. If you should find any inaccuracies in the information made available through the site, you can contact the site administrator (see lower contact details).

TACKLEANDMORE is not liable for any loss or damage of any kind suffered by the Customer or any third party from the use of the products.

The contents of the site (including links) may be adapted, modified or supplemented at any time without notice or notification. TACKLEANDMORE does not guarantee the proper functioning of the website and cannot be held liable in any way for the malfunctioning or temporary (un)availability of the website or for any type of damage, direct or indirect, which may result from the access to or use of the website. In no event shall TACKLEANDMORE be liable to anyone, directly or indirectly, in any special or other way, for damages attributable to the use of this site or any other, particularly as a result of links or hyperlinks, including, without limitation, any losses, work interruptions, damage to programs or other data on the computer system, to equipment, software or other of the user.

The website may contain hyperlinks to websites or pages of third parties, or refer to them indirectly. The placing of links to these websites or pages does not imply in any way an implicit approval of their content. TACKLEANDMORE expressly declares that it has no control over the content or other characteristics of these websites and cannot under any circumstances be held liable for their content or characteristics or for any other form of damage resulting from their use.
 

8.2. General about TACKLEANDMORE's liability:TACKLEANDMORE shall not be liable for any damage it may cause due to its fault or negligence except in the case of intent or gross negligence, including that of its employees. Any damage of any kind that could not be foreseen at the time of the conclusion of the contract is excluded from compensation. The liability of TACKLEANDMORE shall always be limited to the direct, personally incurred damage and shall never exceed the purchase price of the product in question.

 

8.3. Use of material from the TACKLEANDMORE Webshop:

Only with the express permission of TACKLEANDMORE can information on the website be used elsewhere. It is forbidden to modify, copy, reproduce, download, distribute, transfer or commercially exploit and/or distribute the services, the pages of the Web shop or the computer codes relating to them.

9. Copyright and intellectual property:

9.1. We have developed the TACKLEANDMORE Webshop for the personal and non-commercial purposes of the Customer. The entire content of the TACKLEANDMORE Webshop (including layout and design of the website, texts, graphics, photos, images, moving images, sounds, illustrations and software etc.) is the property of TACKLEANDMORE or of related companies, licensees and/or content providers. All associated rights, and in particular all intellectual property rights, are managed by TACKLEANDMORE.
 

The Customer may only download the content and make one copy thereof for purely personal, non-commercial use provided that the content of the material to which the intellectual property rights apply remains in its original state. Copying or storing any content outside of personal, non-commercial use is not permitted.
 

9.2. All trademarks, trade names, logos and products used in the Webshop are protected and may not be used without the prior written permission of TACKLEANDMORE, its partners or the rightful owners of these rights. All signs, illustrations, images or emblems appearing on our products, accessories or packaging are and remain the exclusive property of TACKLEANDMORE. Their reproduction, in whole or in part, for any reason or means, is strictly prohibited. The use of any combination with any other sign, symbol, emblem or other distinctive sign is also prohibited.
 

10. Applicable Law & Disputes:

Only Belgian law shall apply, with the exclusion of the Vienna Convention on Contracts for the International Sale of Goods (C.I.S.G.). All disputes regarding the conclusion, validity, interpretation or execution of the agreement or of the present General Terms and Conditions fall under the exclusive jurisdiction of the Belgian courts. If one of the present conditions should be declared null and void or inapplicable, the other conditions shall nevertheless remain in full force.
 

11. Privacy:

TACKLEANDMORE recognizes the importance of privacy. More information on our privacy policy can be found under "Privacy". By using the TACKLEANDMORE Webshop, the customer accepts this privacy policy. By ordering online in the TACKLEANDMORE Webshop, the customer gives their unambiguous consent to all personal data collected being stored in a file and used for customer data administration, order management, deliveries and invoices, marketing and advertising purposes. For all personal data, the Customer has at all times the right to inspect and modify and the right to oppose the use of such data for direct marketing purposes.
